Terms of Use

1. Purpose

These Terms of Use (ToU) govern access to and use of the CREAVL platform available at: https://www.creavl.com.

CREAVL enables travelers ("Travelers") to access digital guides and itineraries offered by independent creators ("Creators").

By using the platform, you accept these ToU.

2. Creavl's role

CREAVL acts as a technical intermediary enabling Travelers and Creators to connect.

Guides offered on the platform are published and provided under the sole responsibility of Creators.

The guide sales contract is concluded directly between the Traveler and the Creator.

CREAVL is not the author of the content and does not guarantee its accuracy or completeness.

3. Account creation

Some features require account creation.

You undertake to provide accurate information and keep it up to date.

You are responsible for keeping your login credentials confidential and for all activities carried out through your account.

4. Access to guides and digital content

Purchasing a guide gives access to digital content available from your personal space.

Content is intended for strictly personal and non-commercial use.

Any reproduction, distribution, sharing, or resale of content is prohibited.

5. Prices and payment

Prices are shown in euros, including taxes where applicable.

Payments are secured and processed by a third-party payment service provider.

CREAVL does not store any banking data.

6. Right of withdrawal - Digital content

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content supplied immediately after purchase when:

• performance has begun with your express consent;
• you acknowledged that you lose your right of withdrawal.

By confirming your purchase and immediately accessing the content, you expressly acknowledge waiving your right of withdrawal.

7. Liability

CREAVL uses reasonable means to ensure the proper functioning of the platform.

CREAVL cannot be held liable for:

• content published by Creators;
• decisions made based on guides;
• bookings or services offered by third parties through external links;
• temporary service interruptions.

CREAVL's liability is limited to direct and foreseeable damage resulting from a proven fault.

8. User conduct

You undertake not to:

• use the platform for fraudulent purposes;
• disrupt the operation of the service;
• infringe the rights of others.

CREAVL may suspend or delete an account in case of breach of these ToU.

9. Intellectual property

All elements of the platform (design, trademark, logo, database) are protected by intellectual property law.

Any unauthorized use is prohibited.

10. Amendments to the ToU

CREAVL may amend these ToU at any time.

The new terms apply from the date they are published online.

In accordance with the French Consumer Code, any consumer has the right to use, free of charge, a consumer mediator to seek an amicable resolution of a dispute.

Mediation details will be provided upon request.

12. Personal data and cookies

Cookie usage is detailed in the Cookie Management Policy.

13. Governing law

These ToU are governed by French law.

In the event of a dispute, the competent courts will be those designated in accordance with rules applicable to consumers.
